STANDARD TERMS AND CONDITIONS
Web, email, FTP Hosting and co-location services

These terms apply to you as a user of the Service ('Client or you'). Please read these terms and conditions carefully. It is a condition of your use of the Service that you comply with these terms and conditions. If you and we have expressly agreed to different terms in a particular case, the agreement still applies, but subject to those terms.

General
The terms and conditions outlined below are designed to protect and benefit all Clients. In particular, they attempt to ensure that our servers are used only for legal and appropriate purposes, and that no Client uses an ???unfair??? proportion of the system???s resources.

Limitation of Liability
The Client agrees to indemnify and hold APM Internetworks Pty Ltd and its associates harmless from any claims resulting from the use of these services, including claims relating to damage to the subscriber or to any other party.

Use of Servers
Clients should not attempt to access the user account/s of other Clients, and should not attempt to hinder the operation of our servers in any way. We reserve the right to refuse or cancel service to any Client.

Account details (usernames and passwords)
Clients must not reveal their account usernames and/or passwords to ANY third party without the express written permission of APM Internetworks Pty Ltd. Any breach of this condition will lead to the immediate locking of the offending user???s account. APM Internetworks Pty Ltd also reserves the right to refuse or cancel service to any Client found in breach of this condition.

Acceptable Content
Your site must not contain material, or contain any link to material, which is unlawful, pornographic, gambling-related, threatening, hateful, obscene or which encourages unlawful behaviour. This includes any site with depictions of nudity, as well as material relating to hacking or pirated software. We have sole discretion to determine whether a site???s content is acceptable. Sites with unacceptable content will be removed from our servers.

Excess Inbound/Outbound Data
Excess Inbound Data Rate 11c/MB. We reserve the right to charge an Excess Outbound Data fee if Inbound:Outbound Data ratio exceeds 15:1. This will be reviewed on a case by case basis. Outbound Excess Data rate 7c/MB.

No Mirroring
You must not use your site to mirror material on any other site without our express written permission. This permission will usually be declined unless the resources required are minimal.

Bandwidth and Disk Usage
The Client agrees not to exceed the agreed usage as outlined in the current Invoice. Where the Client exceeds the agreed usage/traffic allowance included in the account they will be charged at a rate as outlined in the current Invoice.

CPU Resources
Users acknowledge that the Service is provided on a shared server and agree not to engage in activity that could overwhelm the server with heavy CPU usage or that requires a disproportionate amount of the resources of APM Internetworks Pty Ltd servers, including without limitation, use of highly active CGI scripts or chat scripts.

Unsolicited Email (SPAM)
The Client agrees not to use the facilities and capabilities of APM Internetworks Pty Ltd to solicit the performance of any activity that is prohibited by law or for the illegal distribution of unsolicited email, commonly known as SPAM. Unacceptable use includes, but is NOT limited to: Bulk emailing, unsolicited email, and newsgroup spamming containing commercial advertisements. Failure to comply will result in account suspension or cancellation without prior notice.

Email Size Send/Receive Limitations
APM Internetworks Pty Ltd allocates up to 20Mb of email space per user and encourages the restriction of individual messages to 5Mb in size. APM Internetworks Pty Ltd (without notice) reserves the right to delete any email sent to a customer if the email is greater than 5Mb in size. APM Internetworks Pty Ltd (without notice) reserves the right to block any email that is causing excessive load.

Email storage duration. How long is email held on the servers?
Up to 60 days. APM Internetworks Pty Ltd (without notice) reserves the right to delete any email that has not been deleted within 60 days of becoming available to the user.

Backup
Full backups are made by APM Internetworks Pty Ltd. No guarantees are made of any kind as to the integrity of these backups. If loss of data occurs due to an error of APM Internetworks Pty Ltd Internet Services, we will attempt to restore data at no charge to the customer. If loss of data occurs by an action of the customer, APM Internetworks Pty Ltd will attempt to restore data should the customer agree to the quoted restoration rate.

Billing Cycle, Invoices and Payments
Our billing cycle can be monthly, quarterly or annually in advance dependent on the account type. Payment is due at the time stipulated on the Invoice. Please note that if your payment is overdue then your account(s) may be suspended and/or removed from our servers without notice at our discretion. All fees are non-refundable.

Account Cancellation by User
You must notify us in writing (by email) that you wish to cancel your account. Notification must be submitted at least 14 days prior to account renewal. Your account will then be cancelled at the end of the current invoiced period. If you do not inform us at least 14 days prior to the renewal date your account will be renewed at a rate deemed appropriate for the level of Service/s at the time of renewal. No refunds are payable if you cancel your account in the middle of a paid invoice period. Cancellation does not clear you of any outstanding amounts. Any balance due at the time of cancellation must be paid in full. You must ensure you have a full back-up of your data before cancelling your account as we do not save your data upon cancellation and will not be able to restore that data.

Refusal of Service
IMPORTANT: We reserve the right to refuse or cancel service at our sole discretion. If you breach any of the above terms and conditions we reserve the right to deactivate your account immediately.
